4th2Is there anything left of the Constitution? It doesn’t seem so, and anyone who saw Mukasey answer questions on the famous Yoo memo must be thinking the same thing.

What is at the heart of it? A footnote. A small entry in the memo, which seems to confirm our worst fears about what has happened to our country. That being, the disregard for the Constitution, and a rouge Administration run amuck.

Just to refresh you, here is the Fourth amendment:

“The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no Warrants shall issue, but upon probable cause, supported by Oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized.”

With that, here’s what Representative Dianne Feinstein had to say, and her line of question for Mukasey on April 10, 2008.

“On April 1, 2008, the DOJ released a March 2003 Office of Legal Council Memo written by John Yoo. That memo asserted that President Bush had unlimited power to order brutal interrogations to exact information from detainees. The memo references, on page 8, footnote 10, another OLC memo written by John Yoo written in October 2001. In this memo, the OLC concluded the Fourth Amendment had no application to domestic military operations.

To date your department has refused to declassify and release this memo. Is the October 2001 OLC opinion still considered binding by the department of justice?”

Mukasey’s answer, “I know of no domestic military operations at this time.” Which is such a lawyer type answer, and an obvious attempt on his part to prevent perjuring himself.

What does all this mean? Well let’s recap.

We know that the United States engages in the torture of anyone it suspects as a terrorist. We know that the United States is eavesdropping on all phone calls, emails, web searches, etc… made by American citizens. And now it seems that there has been “domestic military operations?”

What operations? What has the military been doing in this country? To its own citizens? And more important, why are so many going along with it?

The citizens of this country had better start participating in the democracy or there may not be a democracy to participate in. In fact, it may already be too late.
